Upon entering the Facility, I, on behalf of myself, my children, my parents, my heirs, assigns, personal representative and estate, implicitly agree to release and discharge SOUTHAMPTON SPA AND WELLNESS CENTER, ltd., its agents, officers, volunteers, participants, employees and all other persons or entities acting in any capacity on its behalf as follows:

1. I acknowledge that this facility event entails known and anticipated risks which could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks cannot be eliminated without jeopardizing the essential qualities of the activity.
   
   
2. The risks include, among other inherent and extraordinary risks involved in said Spa are: the use of the Swimming Pool, Russian Bath, Turkish Bath, Sauna, Steam Room, Cold Plunge Pool, Jacuzzi's, Showers, and/or other special devices, and any risks inherent in any other activities connected with the use of this facility in which I am voluntarily participating.
   
   
3. Furthermore, I certify and understand that there is NO LIFE-GUARD ON DUTY at SOUTHAMPTON SPA AND WELLNESS CENTER, ltd., and that I am responsible for myself and/or accompanying children. I further ensure that I will be responsible for accompanying children who use the swimming pool or adjacent Jacuzzi's and all other Facilities and will watch them while they are using the facility.
   
   
4. I expressly agree and promise to accept and assure all of the risks existing at the Spa. My participation at the Spa is purely voluntary, and I elect to participate despite of the risks.
   
   
5. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating or else I agree to bear the costs of such injury or damage myself. I furthermore certify that I am willing to assume the risks of any medical or physical condition I may have.
   
   
6. Should SOUTHAMPTON SPA AND WELLNESS CENTER, ltd., or any other acting on their behalf be required to incur attorney's fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.  I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating or else I agree to bear the costs of such injury or damage myself. I further certify that I have no medical or physical conditions which could interfere with my safety at the Spa, or else I am willing to assume and bear the costs of all risks that may be created, directly or indirectly, by any such condition.
   
   
7. By signing this Document, I acknowledge that if anyone is hurt or property damaged during my participation at SOUTHAMPTON SPA AND WELLNESS CENTER, ltd., I may be found by a court of law to have waived my right to maintain a lawsuit against SOUTHAMPTON SPA AND WELLNESS CENTER, ltd., on the basis of any claim from which I have released them herein.
